Terms and conditions

These terms apply to every quote request and every service carried out by Dénomination légale complète (ex: VMCD SRL), unless otherwise agreed in writing.

1. Quotes

Every quote is free and without obligation. It details the services included, the services excluded and the price.

Unless stated otherwise, a quote is valid for thirty days from the date of issue.

The order is formed by the client's written acceptance of the quote, on paper or electronically.

2. Carrying out the work

Dates and time slots are agreed with the client and confirmed before travelling.

The client provides free and safe access to the equipment concerned. If access proves impossible at the agreed time without prior cancellation within a reasonable period, travel costs may be invoiced.

If the visit reveals work not covered by the quote, that work is the subject of a supplementary quote requiring the client's prior agreement. No additional work is carried out without that agreement, except where there is immediate danger to people or the building.

3. Price and invoicing

Prices are expressed in euros. The applicable VAT rate is the one in force on the date of the service; the conditions for applying a reduced rate to building work fall under Belgian tax regulations and are checked case by case.

Unless otherwise agreed on the quote or invoice, invoices are payable within thirty days of the invoice date.

In the event of late payment, late-payment interest and a fixed indemnity may be applied in accordance with Belgian late-payment legislation, within the limits it sets, and after formal notice where required.

4. Consumer right of withdrawal

Where the contract is concluded off-premises or at a distance with a consumer, that consumer has a statutory period of fourteen days to withdraw, without reason and without cost, in accordance with the Belgian Code of Economic Law.

If the consumer expressly requests that performance begin before the end of that period, they remain liable for the amount corresponding to the services already provided at the time of withdrawal.

5. Warranties

Work is carried out in accordance with good practice and manufacturers' instructions.

Parts supplied carry the warranty granted by their manufacturer. Consumers additionally benefit from the statutory warranties provided under Belgian law.

Excluded from warranty: defects resulting from abnormal use, from lack of maintenance after our visit, from modification by a third party, or from a pre-existing defect reported in writing in our service report.

6. Liability

We are liable for direct damage resulting from a fault in carrying out our work.

We are not liable for the consequences of a hidden defect in the building, of a prior design fault in an installation we did not carry out, or of damage resulting from the client's refusal to have work we recommended in writing carried out.

7. Maintenance contracts

Maintenance contracts state their exact scope, duration, visit intervals and the terms for renewal and termination.

Units or premises inaccessible at the scheduled time are recorded as such in the report. The terms of a catch-up visit, and any cost, are set out in the contract.

8. Disputes

These terms are governed by Belgian law.

In a dispute with a consumer, that consumer may use the Consumer Mediation Service free of charge (www.consumerombudsman.be) before any court proceedings.

Failing an amicable resolution, the courts of the district of Dénomination légale complète (ex: VMCD SRL)'s registered office have jurisdiction, without prejudice to mandatory provisions protecting consumers.
